But 40 years ago, the Supreme Court actually banned the practice—only to reverse its ruling in 1976. John Jay Professor Evan Mandery, author of “A Wild Justice: The Death and Resurrection of Capital Punishment in America,” describes how it happened—and what it means for death penalty opponents—on the next episode of Criminal Justice Matters. He’s joined by Jesse Wegman, a member of The New York Times editorial board; and Judge Dorothy Toth Beasley, a former Chief Judge of the Georgia Appeals Court who argued the original case before the High Court.
